Woodland View Terms & Conditions

Below are our Terms and Conditions for booking reservations made at Woodland View Holiday Apartment. These provide you with essential information for your stay with us such as cancellations, amendments, pets and use of the facilities.

Booking terms and conditions

The parties

The parties to this Contract are:

(a) “the Customer”: the person who makes the booking, being 18 years of age or over and who shall assume responsibility for all party members and visitors; and,

(b) “the Vendor”: Woodland View Holiday Apartment.

(c) “the Rental Contract”: refers to the following Terms and Conditions of rental to which the Customer agrees to.

The Rental Contract

This Contract only comes into operation when the Vendor issues a written confirmation to the Customer following receipt and upon processing of the appropriate deposit.

A booking for a holiday will only be confirmed when a deposit of 25% has been received by the Vendor.

The Vendor has the absolute right to refuse any bookings. In this case, monies received will be promptly returned to the Customer. The Vendor reserves the right to cancel or alter arrangements made for the Customer, whether before or during the relevant visit (a) Where any error has arisen regarding availability, (b) in any circumstance that arises from or is attributable to acts, events, omissions or accidents beyond the control of the Vendor or (c) where in the reasonable opinion of the Vendor, it is necessary to perform or complete essential remedial or refurbishment works.

The balance of the booking cost must be received by the Vendor no later than eight weeks before the Customer’s arrival date.

If the Customer books less than eight weeks before the arrival date, payment of the total cost including the deposit shall be due immediately.

The holiday price includes any taxes due to HMRC. The Vendor reserves the right to amend prices accordingly.

All payments shall be made to the “Woodland View Holiday Apartment”.

Cancellation

(a) By the Customer

Non-payment of the balance of rent by the due date will automatically cancel the booking and the booking deposit of 25% of the total cost of the holiday shall be forfeited.

The booking may be cancelled at any time 8 weeks prior to the arrival date by the Customer giving the Vendor notice in writing. On receipt of a written cancellation the Vendor will endeavour to re-book the accommodation for the holiday period and, if successful for the whole or part of the period, will refund the relevant proportion of the money paid less £100 to cover office administration. The Vendor reserves the right to discount the cost of a cancelled week for late availability bookings, which may lead to no refund being payable.

If the customer cancels the booking for any reason following payment in full for the holiday, the entire sum paid is forfeited.

Once a booking has been accepted by the Vendor it can only be changed to different dates by treating the original booking as a cancellation. Please refer to applicable cancellation terms above.

You are strongly advised to take out either independent holiday cancellation insurance or Booking Protect cancellation protection to cover you for having to cancel your holiday due to any conditions which may affect your journey to Woodland View Holiday Apartment. Force majeure includes any event which we could not, even with all due care, foresee or avoid. Such events will usually include (whether actual or threatened) war, riot, civil strife, terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, pandemics, epidemics, fire, closure, restriction or congestion of airspace, airports and ports and all other events outside our control or the UK Foreign Office advice. Please refer to applicable cancellation terms above.

(b) By the Vendor

If, due to circumstances beyond the Vendor’s control, the Customer’s booking is cancelled, the Customer shall be refunded the full amount of the booking in an equal amount to time remaining. We cannot, however pay any compensation or expenses as a consequence of such an event.

Commencement and termination of stay

The Customer should arrive no earlier than 4pm on the start date of the holiday and leave no later than 10am on the final day.

In the event that Customer or any of their Guests fails to comply with the terms set out in this, the Rental Contract, the Vendor can refuse to allow the Customer and their Guests to enter and stay at the Property or can require the Customer and their Guests to leave the Property before the end of the rental period. In either case, the Customer will be treated as having broken the terms of this Rental Contract and the provision set out in the “Rights to end a Rental Contract” section will apply.

Occupancy

The number of people occupying the property must not exceed the maximum number stipulated in the brochure or on the website.

You must not allow any person other than you and your Guests to use the facilities and amenities of the Property without the express permission of the Vendor and to notify all Guests before the rental period starts of your and their obligations.

The Customer is responsible for all Guests staying at the Property and the things they do (and do not do) even if the Customer does not stay there during the rental period.

The Customer must not use the accommodation or allow its use for any dangerous, offensive, noisy, illegal or antisocial activities or carry on there any act that may be a nuisance or annoyance to the Vendor or any neighbours.

No fireworks, Chinese or sky lanterns (or other lights or illuminations that have naked flames) should be let off from the property (including any garden or grounds).

The accommodation is designed for family use, not for youth groups or student parties. The consumption of excess alcohol will not be tolerated and the Vendor reserves the right to terminate the Customer’s stay with immediate effect should this rule be abused or ignored. The Vendor is entitled to refuse entry or to repossess the accommodation if the Vendor reasonably believes that any damage is likely to be caused by the Customer or the Customer’s party.

Additional temporary bedding is not permitted. Sleeping in any room other than the bedrooms, in vehicles, including caravans, parked in or around the property is strictly not permitted.

The facilities

The outdoor Hot Tub is available for use during the stipulated times of between 9:30am and 9pm. Outside of these times allows the Vendor to carry routine daily maintenance.

The Cinema is available for viewing between the hours of 4pm to 11pm. The Vendor will allow time limited use of 3 hours outside of these times upon request.

Care of property, damages and breakages

The Customer undertakes to take reasonable and proper care of the Property and all furniture, utensils, equipment, fixtures and fittings in or on the Property in the same state of repair and condition and tidiness as at the commencement of the rental period.

The Property is fully cleaned and inspected for damages prior to commencement of a rental period.  The Customer must report as soon as possible to the Vendor any breakages or damage caused by you or your Guests during the rental period.

By accepting these Terms and Conditions, you promise to fully reimburse the Vendor for the cost of replacement or repair for such breakages or damage. The costs of replacement or repair will be deducted from the damage deposit. The Vendor may make an additional, reasonable charge for professional cleaning after your and your Guests’ occupancy as may be required to return the Property to its original state of cleanliness and tidiness.

Smoking

Smoking is strictly not permitted inside any part of the property.

Linen and services

There are no additional charges for linen, electricity, heating and water services.

Liability

The Vendor accepts no liability for any accident, damage, loss, injury, expense or inconvenience that may be suffered, incurred, arrived out of, or in any way connected with, the rental.

The provision of Wi-Fi Internet access is a complimentary facility and the Woodland View Holiday Apartment accepts no liability for loss of coverage or quality where technical problems are experienced.

If the property becomes unavailable or unusable for any reason before the start date of the holiday or during the stay, then the Vendor’s obligation will be:

  • to reimburse the client for any monies paid or in the case of disruption during a stay, pro rata.

Please note that our property is in a rural environment and can be subject to environmental conditions beyond our control such as forest flies, bats, house martins, high pollen levels from crops, smells from agricultural activities on neighbouring farms, and so on.

If there is a breakdown of any of the utility services or amenities included as part of the rental at the property (e.g. heating, electrics, Broadband, Hot Tub, Cinema, etc), the Vendor will endeavour to resolve the problem as soon as possible and in the case of utilities, will take any appropriate steps to provide an alternative source of heat/power if possible. No refunds will be provided for any loss of amenity in this respect.

Rights of entry

The Vendor shall be allowed the right of entry to the rental at all reasonable times for the purposes of inspection or to carry out any necessary repairs or maintenance.

Rights to end a Rental Contract

The Vendor may immediately terminate their Rental Contract with the Customer if:

(a) The Customer or their Guests do not comply with the obligations set out in this Rental Contract

(b) The Customer does not comply with the applicable rules on pets.

(c) Circumstances or events outside the Vendor’s reasonable control prevent or are likely to prevent the Customer and their Guests from staying at the Property for the rental period or the Vendor from complying with any other of its obligations under the Rental Contract.

Rates

Prices are subject to change without notice. Your rate will be confirmed at the time of booking; we regret that we cannot change the rate or terms of your stay once a booking has been confirmed.

Complaints

Every care is taken to ensure that Woodland View Holiday Apartment is presented to Customers to a high standard. Should the Customer at any time believe there is a problem, or a cause for complaint, the Vendor should be contacted immediately. This does not affect the Customer’s statutory rights.

Property descriptions and all details written (and verbal) both in our brochure and on our websites are given in good faith and are believed to be correct, but their accuracy cannot be guaranteed. We reserve the right to amend our prices quoted on our website due to error or omission.

Complaints which are not reported immediately, during the holiday, will not be entertained subsequently and certainly not after the end of the rental period. The Vendor must be given every opportunity to rectify any problem identified by the Customer during their stay.  No correspondence will be entered into in respect of complaints made on the day of departure or after the Customer’s return home, when no opportunity has been provided for the Vendor to rectify the problem.

Woodland View Holiday Apartment shall be entitled to vary, amend and/or otherwise change these terms and conditions at any time without prior notice.
